Arnaud Tailfer, Partner, and Claire Tournier, Senior Associate, have contributed to the drafting of the section on reporting obligations for foreign bank accounts, digital asset portfolios, and foreign capitalization contracts. They highlighted the progressive extension of reporting requirements to new asset classes—such as digital asset accounts—and the significant risks associated with non-compliance. They also emphasized the criteria used by tax authorities and case law to identify relevant accounts, which often fall outside any intuitive definition of a “bank account.”
